Terms and Conditions of Use of Table-Booking Services

The services offered at www.table-booking.com are a product of Table-Booking.com LLC, 16192 Coastal Highway, Lewes, Delaware, DE 19958, USA.
TBS Europe Ltd. is located at Atrium Business Centre, Blackpool Business Park, Blackpool, Cork, Ireland.
For purposes of this agreement, table-booking services will be in the following referred as TBS. With this term the User, he or his is being referred to every person visiting, using or submitting information at TBS
TBS offers the User the opportunity to make online reservations in real time or by E-Mail at the TBS participating restaurants. After a successfully completed reservation the User will receive a confirmatory E-Mail that includes the booking details. With the acceptance of this terms and conditions the User is acknowledging that every time he makes a reservation he will receive booking confirmatory E-Mails from TBS. TBS acts in consequence only as an intermediary between restaurant and User not offering any restaurant services themselves.
Online table reservation guidelines
The services regulated by these Terms and Conditions of Use are offered solely for the personal and private use of the User. Once a booking has been made at a TBS participating restaurant, TBS will then inform the restaurant of this reservation, being this free or charge for the User. The User assumes the responsibility to honor the reservation done and is asked to cancel any reservations that he will be unable to honor in accordance with the restaurant cancellation policy.
Cancellation & “No Shows”
In the case the User is unable to honor his reservation the User assumes the responsibility to inform the restaurant by E-Mail or by phone in accordance to its cancellation policy. TBS will be informed by the restaurant about the “No Show” and this will be recorded to prevent it reoccurring. In the case that TBS detects frequent “No Show” TBS will take direct action against the User. In the worst case scenario the User may be expelled from the Gourmet Community. With a completed reservation the User acknowledges that he will be notified via E-Mail of a “No Show”. If the User receives an incorrect “No Show” notification then he is asked to inform TBS with an E-Mail to email@example.com.
Table-Booking Gourmet Community guidelines
a. For an interactive use of TBS Gourmet Community prior registration is necessary. It exists out of creating a personal user profile.
b. Throughout the registration process the User must complete the required information, fully and accurate and his E-Mail will be automatically verified by TBS. Once the registration is completed and the information has been sent, the User agrees with TBS Terms and Conditions of Use.
c. Once registration is complete the new User will obtain a username and password created by him self. The User undertakes to keep this access data confidential being TBS not liable for any damage incurred from improper use of the login data by third parties.
d. Every User will be allocated a personal User profile, in which he is able to upload content such text or pictures. TBS is not responsible for this information, being the User liable for the uploaded content.
Guidelines for the uploading of self-generated Content
TBS offers the members of the Gourmet Community the possibility to upload, E-Mail, transmit or otherwise make available self-generated content. All information, data, text, photographs, graphics, messages or other materials (content), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such content originated.
You agree to not use the TBS Gourmet Community to:
a. upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
b. upload, post, email, transmit or otherwise make available any content that you do not have a right to make available
c. upload, post, email, transmit or otherwise make available any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
d. upload, post, email, transmit or otherwise make available "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
e. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
TBS shall have the right (but not the obligation) in their sole discretion to refuse or remove any content that violate or is otherwise objectionable available via the Website.
TBS Gourmet Community termination
If the User infringes the prescriptions contained on these Terms and Conditions or violates any rights of third-parties mentioned above, TBS may exclude the User from the TBS Gourmet Community with the termination of his Gourmet Community membership, removing all existing uploaded content. The User might not reclaim any previously uploaded content and his existing user profile might be deleted from the Gourmet Community.
E-Mails from Table-Booking
If the User books a table using TBS online reservation system, the User will receive a confirmatory E-Mail which includes the relevant booking data (name and address of the restaurant, date of the reservation, the name of the guest, phone, E-mail and N° of guests). These E-Mails are automatically sent by TBS and cannot be declined by the User.
E-Mails from the Restaurant
When the User makes a reservation using TBS online reservation system will accept the reception of direct E-Mails from the booked restaurant. In this case TBS has no more influence on these E-Mails traffic being the restaurant liable of its content. If the User wants to unsubscribe to these E-Mails he must contact directly the restaurant concerned.
TBS send the members of its Gourmet Community E-Mails with e.g. marketing information, restaurant “Specials” and details new to TBS. If the User does not longer wish to receive these E-Mails he only needs to send an E-Mail to firstname.lastname@example.org.
Both, non-registered User and Gourmet Community members, can determine whether or not he accept to receive TBS newsletter. Even if the User accepts to receive TBS newsletter, afterwards the User can still at any time cancel his subscription and be removed from the mailing by sending an E-Mail to email@example.com.
Limitation of Liability
TBS shall not warrant and disclaims its liability for any kind of damages generated by the use of the services offered its portal, its online reservations system, the on TBS hosted restaurant website, its content or updates. TBS shall not guarantee that its system, server or applications will be uninterrupted available and error free. TBS disclaims its liability in case of loss of saved user information, self-generated content or restaurant data, specially that resulting from the non-availability of TBS system
TBS disclaims its liability for any content or news uploaded by the user at www.table-booking.com in violation with these terms and conditions or offensive to third parties. Furthermore TBS shall not be responsible for the accuracy and completeness of the information or data uploaded by TBS registered members or third parties.
Hyperlink and Widgets
TBS may contain hypertext links to websites operated by third parties. TBS does not control such websites and shall not be liable for their content.
If TBS has placed its widgets on websites operated by third parties that have been displayed any kind of objectable material, TBS reserves the right to discontinue providing this widget at any time and to require the operator to cease displaying, distributing or using the widget.
Modification of Terms and Conditions of Use
Should any individual provision of these Terms and Conditions of Use be of no effect, as a whole or in part, this shall not affect the validity of the remaining provisions. The invalid provision will be deemed replaced by that provision that is legally effective and comes closest, in the usual understanding, to the economic intent and purpose of the invalid provision. The same applies to any unintentional omission.
Applicable Law and Jurisdiction
These Terms and Conditions of Use for the services offered by TBS shall be governed exclusively by the laws of Ireland. The place of jurisdiction for any legal actions related hereto shall be in the courts of the city of Dublin, Ireland.
